Terms & Conditions

The rules for using Brisk, including account conduct, service availability, content rights, and legal protections.

You may use Brisk under a limited personal or internal business license.

You are responsible for lawful use, device security, and any content you submit.

Ink River, LLC may update the service and these Terms with notice where required.

Agreement

These Terms and Conditions apply to the Brisk mobile app and related services operated by Ink River, LLC, collectively called the "Application." Ink River, LLC is the Service Provider.

By downloading or using the Application, you agree to these Terms and Conditions. Please read them carefully before using Brisk.

License

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal or internal business purposes.

You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except where expressly permitted by applicable law.

Intellectual Property

The Service Provider retains all intellectual property rights in the Application, including code, design, trademarks, service marks, trade names, logos, and branding.

Nothing in these Terms grants you a license or right to use the Service Provider trademarks, logos, or branding. You agree not to remove, alter, or obscure proprietary notices displayed in or on the Application.

Eligibility And Termination

You represent that you are legally permitted to use the Application in your jurisdiction. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Application. If you are below that age, a parent or legal guardian must review and accept these Terms on your behalf.

The Service Provider may suspend access if you materially breach these Terms. Where the breach can be cured, the Service Provider will provide written notice and 14 days to remedy it.

Access may be suspended or terminated immediately if you violate applicable law, infringe intellectual property rights, or engage in activity that could harm other users or the Service Provider. Upon termination, your right to use the Application ends and you must delete all copies from your devices.

Acceptable Use

If the Application allows users to post, share, or upload content, you agree not to submit content that violates these Terms, applicable law, or the rights of others.

  • Illegal content or content that violates copyright, trademark, patent, privacy, or personal data rights
  • Abusive, threatening, harassing, defamatory, discriminatory, hateful, or violent content
  • Spam, phishing, malware, misleading claims, false information, or deceptive content
  • Explicit violence or sexual content unless age-gated appropriately

Moderation And Reports

The Service Provider may remove or disable access to content that violates these Terms, suspend or terminate accounts that repeatedly violate guidelines, cooperate with law enforcement, and moderate, filter, or hide content where appropriate.

If you believe content violates these Terms, infringes your rights, or is unlawful, report it to contact@ink-river.com with enough information to identify the content, evaluate the complaint, and contact you if follow-up is needed.

Where available, you may also report content, block users, or mute notifications through the Application interface. Users affected by moderation decisions may contact the Service Provider to request further review.

User Content

By submitting User-Generated Content, you grant the Service Provider a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the Application and Service Provider business.

This license does not grant the Service Provider the right to sell or sublicense your content to third parties independently of the Application.

You represent that you own or control all rights in content you post and that its use does not violate these Terms or applicable law. Personal data in User-Generated Content is governed by the Privacy Policy.

Service Changes And Charges

The Service Provider may modify the Application or charge for services at any time and for any reason. Any charges for the Application or services will be clearly communicated.

The Application stores and processes personal data you provide to deliver the service. You are responsible for maintaining the security of your device and access to the Application.

The Service Provider strongly advises against jailbreaking or rooting your phone because it can compromise security and may cause the Application to stop functioning correctly.

Connectivity And Device Responsibility

Some Application functions require an active internet connection through Wi-Fi or your mobile network provider. The Service Provider is not responsible if the Application does not work at full capacity due to lack of access, exhausted data allowance, or third-party charges.

Your mobile network provider agreement still applies when you use the Application outside Wi-Fi, including data and roaming charges. If you are not the bill payer, you are expected to have permission from the bill payer.

You are responsible for keeping your device charged. If your device runs out of battery and you cannot access the service, the Service Provider is not responsible.

Liability

Nothing in these Terms limits rights you have under applicable consumer protection laws that cannot be lawfully excluded.

To the fullest extent permitted by law, the Service Provider is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

The Service Provider accepts no liability for direct or indirect loss caused by relying entirely on third-party information provided through the Application, or for inaccuracies in third-party content.

  • The Service Provider remains fully liable for death or personal injury caused by negligence.
  • The Service Provider remains fully liable for fraud or fraudulent misrepresentation.
  • The Service Provider remains fully liable for any liability that cannot be excluded or limited under applicable law.
  • Where permitted, total liability for any claim is limited to the amount paid for the Application in the 12 months before the claim, or the minimum required by law, whichever is greater.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider, its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising out of your breach of these Terms or intentional misuse of the Application.

This does not apply to claims arising from the Service Provider own negligence, breach of these Terms, or violation of applicable law. In jurisdictions where consumer indemnification is restricted, this clause is limited to the maximum extent permitted.

Updates And Availability

The Service Provider may update the Application as operating system requirements change. You should accept updates when offered; if you choose not to, earlier versions may stop being supported or may not function properly.

The Service Provider may also cease providing the Application and terminate its use. Unless otherwise stated, termination ends the rights and licenses granted to you, and you must stop using and, if necessary, delete the Application.

Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except where mandatory consumer protection laws provide otherwise.

Any dispute arising out of or relating to these Terms will be brought before courts with jurisdiction under applicable law. This does not limit rights you may have to bring a claim in a court competent under mandatory law.

DSA Compliance

If the Application is an intermediary service under the Digital Services Act, Regulation (EU) 2022/2065, the following provisions apply in addition to the terms above.

Point of Contact: The Service Provider maintains a single point of contact for EU authorities and service recipients at contact@ink-river.com.

Content Moderation: When access to content or features is restricted, the Service Provider will provide a clear and specific statement of reasons where required.

Notice and Action: Users and third parties may submit notices of allegedly illegal content through the contact details in these Terms.

Dispute Settlement: Content moderation disputes may be submitted to a certified out-of-court dispute settlement body where applicable.

Transparency Reporting: Periodic transparency reports are made available upon request at contact@ink-river.com.

General Terms

If any provision is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in effect.

These Terms, together with the Privacy Policy, are the entire agreement between you and the Service Provider concerning use of the Application.

The Service Provider may update these Terms from time to time and will post the updated Terms with an effective date. Previous versions are available upon request.
